Agreement to Terms

By accessing or using The Humidor Club ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

Eligibility

You must be at least 21 years of age to use this Service, in compliance with:

• The federal Tobacco 21 law (enacted December 20, 2019)
• California Proposition 21 and state tobacco laws
• All applicable state and local age restrictions

By using the Service, you represent and warrant that you are at least 21 years old and have the legal capacity to enter into this agreement.

Account Registration

To use certain features of the Service, you must register using Google OAuth. You agree to:

• Provide accurate and complete information
• Maintain the security of your account
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

User-Generated Content

Your Content

You retain ownership of content you create (ratings, reviews, comments, cigar entries). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Display your content on the Service
• Distribute content to other users
• Modify content for technical compatibility
• Use content to promote the Service

Content Standards

You agree that your content will not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Contain false, misleading, or fraudulent information
• Harass, threaten, or abuse others
• Contain spam or unsolicited advertising
• Include malicious code or viruses

Platform Liability (Section 230)

Under 47 U.S.C. § 230, The Humidor Club is not liable for user-generated content posted by third parties. We provide a platform for users to share opinions and information about cigars but do not endorse or verify the accuracy of user submissions.

Prohibited Uses

You agree NOT to:

• Use the Service if you are under 21 years of age
• Post fake reviews or ratings
• Create multiple accounts to manipulate ratings
• Scrape, harvest, or collect user data without permission
• Attempt to gain unauthorized access to the Service
• Use the Service for illegal purposes
• Sell, trade, or promote tobacco products (information only)

Intellectual Property

The Service, including its original content, features, and functionality, is owned by The Humidor Club and is protected by United States and international copyright, trademark, and other intellectual property laws.

Account Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Violation of Community Guidelines
• Fraudulent, abusive, or illegal activity
• At our sole discretion, with or without cause

You may delete your account at any time through your profile settings.

Disclaimers

No Tobacco Sales

The Humidor Club is an informational and social platform only. We do not sell, distribute, or facilitate the sale of tobacco products. Any cigar ratings, reviews, or information are for educational and entertainment purposes only.

No Health Claims

The Service does not provide medical advice or health claims about tobacco products. All tobacco products carry health risks. Consult with healthcare professionals regarding tobacco use.

User Opinions

Ratings and reviews represent individual user opinions and are not verified by The Humidor Club. We are not responsible for the accuracy, completeness, or reliability of user-generated content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE HUMIDOR CLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Indemnification

You agree to indemnify, defend, and hold harmless The Humidor Club, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Arbitration Agreement

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

Class Action Waiver: You agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.

California Residents: You have the right to opt-out of this arbitration agreement within 30 days of registration by emailing [email protected].

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting an update on the Service. Your continued use after changes constitutes acceptance of the modified Terms.

Severability
